General Terms and Conditions for Accommodation Agreement

Article 1
  1. 1.Agreements for accommodation and related agreements to be entered into between this Hotel and the Guest shall be subject to these Terms and Conditions. Any particulars not provided herein shall be governed by laws and regulations and/or generally accepted practices.
  2. 2.In a case where the Hotel has entered into a special agreement with the person to be accommodated, so long as such special agreement does not violate laws and regulations and generally accepted practices, the special agreement shall supersede the provisions of these Terms and Conditions, notwithstanding the preceding Paragraph.

Requesting an Application Agreement

Article 2
  1. Persons requesting an Application Agreement shall provide the Hotel with the following information:
    1. 1. Name of guest(s);
    2. 2. Date of accommodation and estimated time of arrival;
    3. 3. Accommodation rates (in principle, based on the Standard Accommodation Rates in Attachment Table 1); and
    4. 4. Other information the Hotel deems necessary
  2. 2.If, during their stay, Guests request to extend their stay beyond the date in Item 2 of the preceding Paragraph, it shall be regarded as a request for a new Accommodation Agreement at the time such a request is made.
  3. 3.Online Reservations
    1. 1.When making reservations online through the Hotel’s website, enter information in the reservation form. Online reservations requests made by means other than by entering information into the online reservation form may be rejected.
    2. 2.The reservation may be rejected as a result of failure to provide all required information or if the provided information differs from facts.

Conclusion of Accommodation Agreement, etc.

Article 3
  1. 1. The Accommodation Agreement shall be deemed to have been concluded when the Hotel has duly accepted the request as stipulated in the preceding Article. However, the same does not apply when it has been proven that the Hotel has not accepted the request.
  2. 2.When an Accommodation Agreement has been concluded in accordance with the provisions of the preceding paragraph, the person requesting accommodation may be asked to pay a deposit set by the Hotel within the limits of Standard Accommodation Rates for the Guest’s entire period of stay (for 3 days when the period of stay exceeds 3 days) by the date specified by the Hotel.
  3. 3.The deposit shall be first used for the total accommodation charges to be paid by the Guest, secondly for cancellation fees under Article 6 and thirdly for reparations under Article 18, when applicable. The remainder, if any, shall be refunded at the time of payment for accommodation as set forth in Article 12.
  4. 4.If the Guest fails to pay the deposit by the date set forth in Paragraph 2, the Hotel shall deem the Accommodation Agreement to be invalid. However, the above shall apply only in a case where the Guest is duly informed by the Hotel when the payment due date of the deposit is specified.

Special Contracts Requiring No Accommodation Deposit

Article 4
  1. 1.Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special agreement requiring no accommodation deposit after the Agreement has been concluded as stipulated in the same paragraph.
  2. 2.In a case when the Hotel did not request payment of the deposit as stipulated in Paragraph 2 of the preceding Article and/or did not specify a payment due date for the deposit at the time the request for an Accommodation Agreement was accepted, it shall be treated in the same manner as when the Hotel accepts a Special Agreement set forth in the preceding paragraph.

Refusal of Accommodation Agreement

Article 5
  1. 1.The Hotel may refuse the conclusion of an Accommodation Agreement under any of the following circumstances:
    1. 1.When the application for accommodation does not conform with the provisions of these Terms and Conditions;
    2. 2.When the Hotel is fully booked and has no vacancies;
    3. 3.When the person requesting accommodation is deemed liable to conduct acts that would violate laws and ordinances, or is contrary to public order or good morals in regard to the Guest’s accommodation;
    4. 4.When the person requesting accommodation is determined to fall under a to c below;
      1. 1.When determined to be an organized crime group (hereinafter referred to as “Organized Crime”, under Article 2-6 of Law on Preventing Unreasonable Conduct by Organized Crime Groups (Code 77 issued in 1991), a member of Organized Crime (hereinafter referred to as an “Organized Crime Member”), an associated member of Organized Crime, affiliated with Organized Crime or has ties to other anti-social forces under Article 2-6 of the same law.
      2. 2.When determined to be a corporation or organization operated by Organized Crime or an Organized Crime Member.
      3. 3.When determined to be a corporation whose board members are identified as an Organized Crime Member.
    5. 5.When the person requesting accommodation makes comments that causes significant discomfort to other Guests;
    6. 6.When the person requesting accommodation acts violently, makes threats, intimidates, makes coercive demands or demands unreasonable actions; or conducts any other acts which may cause trouble for facility (staff) or other Guests, or it is determined that such acts were conducted in the past;
    7. 7.When the person requesting accommodation can be clearly identified as carrying an infectious disease;
    8. 8.When the Hotel is unable to provide accommodation due to natural disaster, malfunctions in facilities and/or other unavoidable causes;
    9. 9.When the person requesting accommodation is intoxicated and is liable to be an annoyance to other guests.

Right to Cancel Accommodation Agreements by the Guest

Article 6
  1. 1.The Guest may cancel the Accommodation Agreement by notifying the Hotel.
  2. 2.When the Guest cancelled the Accommodation Agreement in whole or in part due to reasons of the Guest (except in cases when the Hotel has requested payment of a deposit during the specified period as set forth in Article 3 Paragraph 2 and the Guest cancelled before payment is made), the Guest shall pay cancellation fees as listed in Attachment Table 2. However, in the case when a special agreement as set forth in Article 4 Paragraph 1 has been concluded, the above shall apply only when the Guest was duly informed of the obligation to pay cancellation fees in the event of a cancellation due to reasons of the Guest.
  3. 3.If the Guest does not arrive by 10:00 p.m. on the date of reservation without advance notice (if the Hotel was notified of the expected time of arrival in advance, 2 hours after the expected time of arrival or by midnight), the Hotel may deem the Accommodation Agreement cancelled by the Guest.

Right to Cancel Accommodation Contract by the Hotel

Article 7
  1. 1.The Hotel may cancel the Accommodation Agreement for the following reasons;
    1. 1.When the Guest used a fake hotel membership card or the membership was used by a person other than the person registered for membership;
    2. 2.When the Guest refuses to make payment set forth in Article 12 Paragraph 2;
    3. 3.When the Guest refuses to comply with the requests in Article 8 Paragraph 1.
    4. 4.When the Guest is deemed liable for conduct and/or has acted in a manner that violates laws or ordinances or is contrary to public order or good morals in regard to the Guest’s accommodation;
    5. 5.When it is attempted to use the accommodation for more than the number of Guests the accommodation was reserved for;
    6. 6.When the Guest can be clearly identified as carrying an infectious disease;
    7. 7.When the Hotel is unable to provide accommodation due to natural disaster, malfunctions in facilities and/or other unavoidable causes;
    8. 8.When the Guest is intoxicated and is liable to be an annoyance to other guests.
    9. 9.When the Guest is determined to fall under a to c below:
    10. 10.When determined to be Organized Crime, an Organized Crime Member, associated member of Organized Crime, affiliated with Organized Crime or has ties to any other anti-social forces;
    11. 11.When determined to be a corporation or organization operated by Organized Crime or an Organized Crime Member;
    12. 12.When determined to be a corporation whose board members are identified as an Organized Crime Member;
    13. 13.When the Guest makes comments that cause significant discomfort to other Guests;
    14. 14.When the Guest acts violently, makes threats, intimidates, makes coercive demands or demands unreasonable actions; or conducts any other acts which may cause trouble for facility (staff) or other Guests, or it is determined that such acts were conducted in the past;
    15. 15.When the Guest does not observe prohibited actions such as smoking in bed, tampering with fire-fighting equipment or any other prohibited acts stipulated in the regulations set forth by the Hotel (restricted to stipulations required for fire prevention).

Registration

Article 8
  1. The Guest shall register the following information at the Front Desk of the Hotel on the day of arrival:
    1. 1.Name, age, gender, address and occupation of the Guest(s);
    2. 2.If a Guest is a foreign national, nationality, passport number, port and date of entry in Japan;
    3. 3.Date and estimated time of departure; and
    4. 4.Other information the Hotel deems necessary
  2. In the case where the Guest intends to pay the accommodation charges stipulated in Article 12 by any means other than in cash in Japanese currency, such as by traveler’s checks, vouchers, or credit cards, the method of payment must be presented at the time of registration as set forth in the preceding paragraph.

Occupancy Hours of Guest Rooms

Article 9
  1. 1.The Guest may occupy the agreed guest room of the Hotel from 3:00 p.m. on the day of arrival to 10:00 am of the following day. However, in the case when the Guest stays consecutively for more than 1 day, the Guest may occupy the guest room all day, except on the day of arrival and departure.
  2. 2.Notwithstanding the provisions set forth in the preceding Paragraph, the Hotel may permit the Guest to occupy the guest room beyond the time stipulated in the same paragraph. In this case, the following extra charges shall apply:
    1. 1.Until 3:00 p.m. Single room is 1,000 yen per hour (tax included)
      Double · Twin room · Universal room is 2,000 yen per hour (tax included)
      Suite room is 4,000 yen per hour (tax included)
    2. 2.After 3:00 p.m. 100% of the Standard Accommodation Rate (Guest Room Rate)

Compliance with Usage Rules

Article 10
  1. 1.The Guest shall comply with the Hotel Usage Rules set forth by the Hotel when on Hotel premises.

Hours of Operation

Article 11
  1. 1.The hours of operation of facilities and such of the Hotel can be found in brochures, signs at each facility, service directories in guest rooms, etc.
  2. 2.The hours of operation in the preceding paragraph are subject to temporary change due to unavoidable circumstances of the Hotel. In the event of such a case, Guests shall be informed by appropriate means.

Payment of Accommodation Charges

Article 12
  1. 1.The accommodation charges, etc. to be paid by the Guest are itemized in Attachment Table 1.
  2. 2.Accommodation charges, etc. as stipulated in the preceding paragraph shall be by paid in cash in Japanese currency or by other means such as by traveler’s checks, vouchers, or credit card at the Front Desk at the time of the arrival, at the time the Guest’s stay is extended, or upon request by the Hotel.
  3. 3.Accommodation charges shall be paid even if the Guest voluntarily does not utilize the guest room provided to the Guest upon being made available by the Hotel.
  4. 4.Charges for breakfast, lunch or dinner or any other service(s) included in a Guest’s stay plan shall be paid even if the Guest voluntarily does not have the meal(s) or does not utilize the service(s).

Liabilities of the Hotel

Article 13
  1. 1.The Hotel shall compensate the Guest for any damage caused by the Hotel to the Guest in the fulfillment or the nonfulfillment of the Accommodation Agreement and/or related agreements. However, this does not apply in cases where such damage was caused due to reasons for which the Hotel is not liable.
  2. 2.The Hotel is covered by Hotel Liability Insurance to deal with unexpected fires and/or other disasters.

Actions when Unable to Provide Rooms in the Agreementい

Article 14
  1. 1.When unable to provide the rooms in the Agreement, upon consent of the Guest and to the extent possible, the Hotel shall arrange accommodation of the same standard at a different location for the Guest.
  2. 2.When arrangement of other accommodation cannot be made notwithstanding the provisions of the preceding paragraph, the Hotel shall pay the Guest a compensation fee equivalent to the cancellation fees and the compensation fee shall be applied to the reparation amount. However, when the Hotel cannot provide accommodation due to causes for which the Hotel is not liable, the Hotel shall not pay a compensation fee to the Guest.

Handling of Entrusted Articles

Article 15
  1. 1.The Hotel shall compensate the Guest for any damages when loss, breakage or other damage is caused to goods, cash or valuables entrusted at the Front Desk by the Guest, except in cases when the damage is due to force majeure. However, for cash and valuables, if the Hotel had asked the Guest to provide information such the type and value of the entrusted article(s) and the Guest failed to disclose this information, the Hotel shall compensate the Guest up to a maximum of 50,000 yen.
  2. 2.The Hotel shall compensate the Guest for damages when loss, breakage or other damage is caused intentionally or through negligence on the part of the Hotel to any goods, cash or valuables brought onto Hotel premises by the Guest but not deposited at the Front Desk. However, for articles for which the type and value was not reported in advance by the Guest, the Hotel shall compensate the Guest up to a maximum of 50,000 yen.

Custody of Baggage and/or Belongings of Guest

Article 16
  1. 1.When baggage of a Guest arrives at the Hotel before the Guest arrives, the Hotel shall be liable for its storage only in the case when such a request has been accepted from the Hotel. The baggage shall be handed over to the Guest at the Front Desk when the Guest checks in.
  2. 2.When baggage or belongings of a Guest are found after check-out and ownership of the article(s) is confirmed, the Hotel shall notify the owner of the article left behind and request further instructions. However, when no such instructions are given to the Hotel by the owner of the article(s) or when ownership cannot be confirmed, the Hotel shall take action in accordance with the Lost Goods Act.
  3. 3.The Hotel’s liability in regard to custody of the Guest’s baggage and belongings in cases set forth in the preceding two paragraphs shall be in accordance with the provisions of Paragraph 1 of the preceding Article in the case of Paragraph 1, and with the provisions of Paragraph 2 of the same Article in the case of Paragraph 2.

Liability of the Guest

Article 17
  1. 1.The Guest shall compensate the Hotel for any damage(s) caused intentionally or by negligence on the part of the Guest.

≪Note≫

  1. 1.The percentage is the penalty rate for cancellation fees against the accommodation charges.
  2. 2.When the number of days of required accommodation is shortened, regardless of the number of days shortened, a cancellation fee equivalent to 1 day (the first day) of accommodation shall be paid by the Guest.
  3. 3.If a separate cancellation fee was agreed to in an Agreement, the amount set forth in the agreement shall be applied.
